Terms of Service
GILVER AI INCORPORATED
Effective date: September 11, 2026
Last updated: September 11, 2026
GILVER SHOWS YOU THE MARKET. IT DOES NOT ADVISE YOU ON IT.
Nothing on this Service is investment advice. Nothing on it is a forecast. The numbers can be wrong, delayed or missing, and some of them are our own estimates rather than measured quantities. Read Section 4 in full before you rely on anything you see here.
1. Agreement to these Terms
1.1 Who we are
These Terms of Service (the "Terms") are a binding agreement between you and GILVER AI INCORPORATED, a Delaware corporation ("Gilver", "we", "us", "our").
You may contact us at siraj@gilver.ai.
1.2 What these Terms cover
These Terms govern your access to and use of the website at https://gilver.ai, the web application at https://app.gilver.ai, and any related pages, content, data, graphics, 3-D scenes, application programming interfaces, feeds and features that we make available and that link to these Terms (together, the "Service").
1.3 How you accept these Terms
The Service requires no account and presents no form for you to complete or submit. Agreement to these Terms is therefore formed by your accessing or using the Service after notice of them has been given to you. Notice is given by a legible link headed "Terms of Service" that appears in the footer of every page of the Service. If you do not agree to these Terms, you should not access or use the Service.
Our Privacy Policy is available at https://gilver.ai/privacy (the "Privacy Policy") and is incorporated into these Terms by reference. It describes what we collect and why. Section 3.6 of these Terms summarises the same ground in short form.
1.4 Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page and post the revised version at the same location.
If a change is material, we will take reasonable steps to give notice before it takes effect, for example by posting a notice on the Service. Material changes take effect no earlier than fourteen (14) days after they are posted, except where a change must take effect sooner for legal or security reasons.
1.5 Order of precedence
Some features carry their own notices or terms. Where one of those conflicts with these Terms, it controls for that feature only, and only as to how that feature works. These Terms govern everything else.
This Section 1.5 does not apply to Sections 4, 12, 13, 14, 15 or 16. Those Sections control over any in-product notice, label, tooltip, caption, help text, marketing statement or summary. An in-product notice may add to those Sections, but can never narrow, qualify or displace them, whatever its wording and however specific it is.
2. Eligibility and who may use the Service
2.1 Age
You must be at least 18 years old, or the age of majority in your state or territory of residence if that is higher, to use the Service. By using the Service you represent that you meet this requirement.
2.2 Not for children
The Service is not directed to children. We do not knowingly collect personal information from, or permit the use of the Service by, anyone under 18, and we do not knowingly collect personal information from anyone under 13. If you believe a child has provided us with personal information, write to siraj@gilver.ai and we will delete it.
2.4 Sanctions, export control and lawful use
You represent that you are not located in, ordinarily resident in, or organised under the laws of any country or region subject to comprehensive United States sanctions, and that you are not a person with whom United States persons are prohibited from dealing, including any person on the U.S. Treasury Department's Specially Designated Nationals and Blocked Persons List or the U.S. Commerce Department's Denied Persons or Entity Lists. You agree not to use or export the Service in violation of United States export control or sanctions laws.
2.5 Accounts
The Service does not offer user accounts. It requires no login, issues no passwords and maintains no user profiles. If we introduce accounts in the future, they will be governed by their own terms, and we will ask you to agree to those terms at that time.
2.6 On behalf of an organisation
If you use the Service on behalf of a company or other organisation, you represent that you are authorised to bind that organisation to these Terms, and "you" refers to both you and that organisation.
3. The Service
3.1 What the Service is
The Service is a market-visualisation and intelligence platform. It presents market data as interactive visual environments rather than as tables of figures. The Service includes, or may include:
- A 3-D multi-asset view. Prices for precious metals and Bitcoin, refreshed as often as we are able to retrieve them and subject to Section 5.2, drive the appearance and behaviour of objects on screen: bullion bars and a Bitcoin cuboid whose condition and motion encode recent price behaviour, alongside a stage of monuments representing the world's largest listed companies, scaled by market capitalisation, revenue or earnings.
- Company "worlds". 3-D scenes for a set of very large companies that illustrate, in a stylised and simplified way, how each business works. Several are interactive and some are playable as short games or simulations.
- Capital Flow. A cross-asset rotation board that visualises where relative strength has moved between sectors and assets over a period, using sized arrows and sector bubbles. Section 5.4 describes what the figures on that board represent and should be read before any of them is quoted.
- Public company pages and reference content. Server-rendered pages carrying prices, key facts, filings-derived developments and headlines.
- Charts and market history for a limited set of instruments.
3.2 Provided free of charge
The Service is provided free of charge. We operate no paid tiers as of now, subscriptions, fees or payment processing, and we do not accept payment from users of the Service.
We reserve the right to introduce paid features. If we do, we will publish the applicable pricing and payment terms before any charge can arise, and nothing in these Terms authorises us to charge you before you have separately agreed to those terms.
3.3 Availability, eligibility and access
Nothing on the Service creates any obligation on us to make the Service, or any part of it, available to you. You are not entitled to access, to continued access, to any particular feature set, or to access on any particular terms. We may introduce, stage, restrict, geographically limit, suspend or withdraw any part of the Service at our discretion, and we may set eligibility conditions for any feature. We may decline or revoke access to any person for any lawful reason.
3.4 Features change
We may add, change, suspend, restrict, degrade or remove any feature, asset, data series, page or scene at any time, with or without notice. Where content on the Service is labelled as a draft, a preview, an illustration or a planned item, that label describes the state of that content, and we give no assurance that it will be completed, retained or made available.
3.5 Beta and experimental features
Some features may be offered as experimental, preview or beta. They may be unstable, incomplete or withdrawn without notice, and they are provided with an even lower expectation of accuracy and availability than the rest of the Service.
3.6 What we collect
The Service requires no account and presents no form for you to submit, and the information we hold about you is correspondingly limited. The Privacy Policy is the complete statement. This Section is a summary of it, provided here so that you need not open a second document to learn the substance.
4. INVESTMENT DISCLAIMER — PLEASE READ THIS SECTION
This is the most important section of these Terms.
4.1 Nothing on the Service is advice
THE SERVICE IS PROVIDED FOR GENERAL INFORMATIONAL, EDUCATIONAL AND ILLUSTRATIVE PURPOSES ONLY. NOTHING ON THE SERVICE — NO PRICE, NO CHART, NO ARROW, NO SCENE, NO FIGURE, NO LABEL, NO NARRATIVE, NO AI-GENERATED COMMENTARY, NO "DRIVER", NO SENTIMENT READING, NO CONSENSUS INDICATOR, NO "ANALYST VIEW", NO GAME OUTCOME, NO RANKING — IS INVESTMENT ADVICE, FINANCIAL ADVICE, TAX ADVICE, ACCOUNTING ADVICE OR LEGAL ADVICE, AND NONE OF IT SHOULD BE TREATED AS SUCH.
4.2 No advisory or fiduciary relationship
Using the Service does not create an advisory, fiduciary, brokerage, agency, or professional-client relationship of any kind between you and Gilver. We owe you no duty of suitability, no duty of best execution, no duty of care in respect of your portfolio, and no fiduciary duty.
4.3 We are not a broker
Gilver is not a broker-dealer, not a registered investment adviser, not a commodity trading advisor, not a futures commission merchant, not a bank, not a custodian, and not a money transmitter. We are not registered with, and not supervised by, the U.S. Securities and Exchange Commission, the Financial Industry Regulatory Authority, the Commodity Futures Trading Commission, or any state securities regulator, in any of those capacities.
The Service does not execute trades. It does not connect to your brokerage, bank, wallet or exchange. It never holds, custodies, transmits or has access to your money or your securities.
4.4 Nothing is an offer, solicitation or recommendation
No part of the Service is an offer, a solicitation of an offer, an inducement, an endorsement, or a recommendation to buy, sell, hold, short, stake, lend or otherwise deal in any security, commodity, digital asset, fund, derivative or other financial instrument, nor to adopt any investment strategy. The appearance of an asset, company, ticker or instrument on the Service is not a view about it, and the absence of one is not a view either. The visual prominence, size, colour, brightness, position or animation of anything on screen is a design choice, not a signal about merit.
4.5 Every decision is yours
YOU ARE SOLELY RESPONSIBLE FOR YOUR OWN FINANCIAL DECISIONS AND FOR THE CONSEQUENCES OF THEM. You should not make, refrain from making, delay or accelerate any investment or financial decision on the basis of anything you see on the Service. Before acting, do your own research and consult a licensed professional, such as a registered investment adviser, broker, accountant or attorney, who knows your circumstances, objectives, tax position and risk tolerance. We know none of those things about you, and the Service does not attempt to assess whether anything shown is suitable for you.
4.6 Past performance, backtests and simulations
Past performance is not a reliable indicator of future results.
Parts of the Service present historical, hypothetical, simulated, backtested or game-based outcomes, for example a scene that shows what a hypothetical sum invested in the past would be worth today, or a playable simulation scored against a hypothetical alternative. Hypothetical and simulated results have inherent limitations. They are constructed with the benefit of hindsight, they do not represent actual trading, they do not account for fees, taxes, spreads, slippage, liquidity, dividends, timing, or the difficulty of holding a position through a drawdown, and no person has achieved them by using the Service. They are illustrations of history, presented for education and entertainment, and they should not be treated as a projection of any return you would obtain.
4.7 No forecasts
The Service does not itself forecast prices, and we publish no price target of our own. Some commentary on the Service, including AI-generated sentiment and any text labelled "Analyst View", summarises directional views held by third parties and may repeat support, resistance or target levels that those third parties have published. They are not a prediction, not a probability, not a confidence interval, and not a statistical model of future returns, and some of them may be considerably out of date.
Where a part of the Service displays a confidence or consensus label, that label describes how an internal process characterised the information in front of it at a point in time. It is not a probability that anything will happen, and it carries no predictive claim.
4.8 Markets are risky
Trading and holding financial assets involves substantial risk, including the risk of losing some or all of the money you put in. Precious metals, equities, bonds, funds and digital assets can fall sharply and without warning. Digital assets in particular are volatile, may be illiquid, may be subject to fraud, network failure or custodial loss, and are in many respects unregulated. Losses in digital assets are frequently permanent and unrecoverable. Leverage magnifies losses. Only you can judge what risk you can bear.
4.9 Publication, not advice
Gilver operates as a publisher of impersonal market information of general and regular circulation. Everything on the Service is prepared for, and made available to, the public generally, on identical terms, at the same time. Nothing on the Service is tailored to, or takes any account of, your identity, your holdings, your objectives, your time horizon, your tax position or any other circumstance of yours, and no output of the Service is personalised or individualised, however it is labelled or however it appears.
Where the Service displays a bull or bear reading, a "driver", a weighting, a score, a sentiment or consensus label, a ranking or an ordering, that display is an automated characterisation of publicly available commentary and observed price behaviour at a point in time. It is not a rating, not a recommendation, not a price target, not a research report, and not an opinion of Gilver or of any person, about the merits or prospects of any asset, for you or for anyone else.
4.10 Compensation and positions
We do not accept, and have not accepted, money, securities, digital assets or any other consideration from any issuer, exchange, fund, sponsor, promoter or their agents in return for including, featuring, ranking, sizing, timing, describing or portraying any asset, company or instrument on the Service, or for the manner in which any of them appears. If that ever changes, we will disclose the fact of the compensation, its source and its amount clearly and prominently at the point where the content appears, as Section 17(b) of the Securities Act of 1933 requires.
4.11 No reliance
You acknowledge and agree that you have not relied, do not rely, and will not rely on any price, figure, chart, arrow, scene, label, estimate, visualisation, AI-generated statement, ranking, omission or other content on the Service, or on any statement made by or on behalf of Gilver outside these Terms, in making, refraining from making, timing or sizing any investment, financial or commercial decision. You acknowledge that the Service is not designed or fit to be used as a source of truth for any such decision, that these Terms state that expressly, and that you have accepted these Terms on that basis. Nothing in this Section limits liability for fraud or fraudulent misrepresentation.
5. Market data, figures and accuracy
5.1 Where the data comes from
The market data on the Service is obtained from third-party sources, including licensed commercial market-data vendors, public filings and disclosures from United States government bodies, and publicly available reference sources. We do not originate prices and we are not the exchange of record for anything.
5.2 Data may be wrong, delayed or missing
Market data on the Service may be delayed, interrupted, incomplete, unavailable, out of date, mis-stated or simply wrong. Refresh intervals differ substantially between asset classes. Some series update within seconds, others hourly, others monthly, and a figure displayed prominently may be considerably older than it appears. A displayed value may be the last value we successfully retrieved rather than the current one. Data may stop updating without an on-screen indication that it has done so.
We do not independently verify third-party data. We give no warranty of accuracy, completeness, timeliness, continuity, or that data arrives in the right order, and we are under no obligation to correct, restate, annotate or notify you of any error, although we may do so.
5.3 Estimates, proxies and derived figures
Some figures on the Service are not measured quantities. Among other things:
- Certain sector and asset-class totals are Gilver estimates, derived from reference values and price ratios rather than published totals. They will differ, sometimes materially, from figures quoted elsewhere, and because we re-check them against source values only periodically, they may drift between those checks.
- Certain sectors are represented by a single exchange-traded fund used as a proxy for the wider sector, which is a simplification and will not track the sector exactly.
- Certain "market capitalisation" figures for physical commodities are calculated from an estimate of total quantity ever produced multiplied by spot price. That is a modelling convention, not a claim about how much of the metal exists, is held, or is available to trade.
- Fundamental figures such as revenue and earnings reflect each company's most recently reported fiscal year, and fiscal calendars differ between companies. They are not live and are not comparable period-for-period without care.
5.4 Capital Flow is a relative-momentum visualisation, not measured money
The Capital Flow board does not measure the movement of money. Its arrows, directions, widths and most of its dollar figures are an analytical interpretation derived from relative price performance. They are not measured, reported, settled or observed transfers of funds. A dollar figure shown next to an arrow expresses the scale of a modelled relationship between price changes and estimated asset-class size. It is not an amount of money that moved, and it should not be quoted as one.
With two exceptions, no transaction data, fund-flow data, creation and redemption data or settlement data is used to produce the figures on that board. The exceptions are:
- the Stablecoins figure, which is the change in total stablecoin supply since the window opened, and which therefore does reflect real minting and redemption; and
- the Cash figure, which is the change between two consecutive monthly observations of total U.S. money-market-fund assets published by the Office of Financial Research from SEC Form N-MFP filings.
Those two are measured quantities. Every other figure on the board is not.
The window labels "24H", "7D" and "30D" do not denote the preceding 24 hours, 7 days or 30 days. Each denotes the period since the current day, week or month began. Early in a week, therefore, the 7D figure and the 24H figure may be the same figure. Figures published elsewhere are ordinarily calculated over true rolling windows and will not match ours, and our own figures are not strictly comparable with one another either, because assets that trade continuously are measured on a different clock from assets that trade in sessions.
The Cash reading is calculated on a different basis again, and is labelled as such in the Service. It compares the two most recently published monthly observations of money-market-fund assets. It is a month-over-month figure whose latest observation typically lags month-end by approximately two weeks, and it is shown only on the 30D range.
5.5 Third-party data rights
All third-party market data, filings-derived content, headlines, logos and reference material displayed on the Service remain the property of their respective owners and providers, and are protected by copyright and other laws. We display that content under the terms on which it is licensed or made available to us.
Nothing in these Terms transfers to you any right, title, interest or licence in any third-party data. The permissions in Section 8.3 apply to Gilver's own material and to the incidental appearance of third-party data within a screen capture. They are not a licence to any third party's data, and they are in every case subject to and limited by the terms on which that data is licensed or made available to us. Where a provider's terms are narrower than Section 8.3, the provider's terms control and Section 8.3 is reduced accordingly for that provider's data, without further notice to you. Your use of third-party data is in all cases subject to the restrictions in Section 7.
Certain providers require attribution where their data is displayed. Where an attribution, credit or source line appears in the Service or in an export, you must not remove, obscure, alter or detach it.
5.6 Your own verification
You are responsible for verifying any figure before you rely on it, and for consulting an authoritative primary source, such as the exchange, the issuer, the regulator's filing system, or your broker, where accuracy matters to you.
5.7 No warranty or duty from our data providers
Our data providers, their own sources, and any exchange or issuer from which data originates make no warranty to you of any kind, express or implied; accept no responsibility or liability to you for the data, its accuracy, its timeliness, its continuity or your use of it; and owe you no duty of any kind. You will not bring any claim against any of them in connection with the Service or anything displayed on it. Sections 12 and 13 apply to each of them as they apply to us.
6. Acceptable use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree that you will not, and will not attempt to, and will not authorise or help anyone else to:
6.1 Extraction and automation
- 6.1.1 Scrape, crawl, spider, harvest, index or bulk-download any part of the Service, or any data, content, figures, imagery, geometry or media on it, by any automated means, except by a crawler that is expressly permitted by, and that fully obeys, a
robots.txtpublished at the relevant domain. Where a domain publishes norobots.txt, no automated access to it is permitted. - 6.1.2 Access any endpoint, stream or feed programmatically other than as we expressly document and permit, or use any interface intended for a browser as if it were a public API.
- 6.1.3 Circumvent, disable, reverse-engineer, forge or interfere with any rate limit, quota, session token, origin check, access gate, preview token or other access-control or anti-abuse mechanism, or use tokens, headers or credentials obtained from the Service in any client other than the one that obtained them.
- 6.1.4 Hold open, multiply, replay or otherwise abuse server-sent event streams, websockets, long-polling connections or other streaming endpoints, or issue requests at a volume, frequency or concurrency that is disproportionate to normal personal use or that degrades the Service for others.
- 6.1.5 Use proxies, distributed addresses, rotating identifiers or multiple submissions to evade any limit, gate, quota or block.
6.2 Data redistribution and competing products
- 6.2.1 Redistribute, republish, resell, sublicense, syndicate, broadcast, or otherwise make available to any third party any market data, price, figure, estimate, derived value, dataset or compilation obtained from the Service, whether on a standalone basis, as part of another product, or as a feed.
- 6.2.2 Build, train, populate, benchmark or maintain a database, dataset, index, model or product that competes with, substitutes for, or reconstructs the Service or any material part of its data or compilations, including by accumulating values over time.
- 6.2.3 Use the Service, or data obtained from it, as the basis for a financial product, benchmark or index, or to price, settle, value or determine the terms of any instrument or transaction.
- 6.2.4 Use the Service or its outputs to train, fine-tune, distil or evaluate a machine-learning model, except to the extent this cannot lawfully be prohibited.
6.3 Security and integrity
- 6.3.1 Probe, scan or test the vulnerability of the Service or any related system or network, or breach or attempt to breach any security or authentication measure.
- 6.3.2 Access or attempt to access any account, data, system, environment or area of the Service that you are not authorised to access, including administrative interfaces, non-production environments and internal endpoints.
- 6.3.3 Introduce any virus, worm, malicious code, or anything designed to disrupt, damage, overload or gain unauthorised access to the Service, or launch any denial-of-service or similar attack.
- 6.3.4 Reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, models, methodology, weights, anchor constants, prompts or underlying structure of the Service, except to the extent that restriction is prohibited by applicable law.
- 6.3.5 Remove, obscure or alter any copyright, trademark, attribution, source, credit or disclaimer notice.
Good-faith security research. Clauses 7.3.1 and 7.3.4 do not apply to good-faith security research conducted with our prior written permission, or in accordance with any vulnerability disclosure policy that we publish. We will not pursue a claim under the Computer Fraud and Abuse Act or an equivalent state law against a researcher who acts in good faith within those limits. Suspected vulnerabilities may be reported to siraj@gilver.ai.
6.4 Abuse, misuse and misrepresentation
- 6.4.1 Submit false information, information belonging to another person, or automatically generated information through any interactive feature of the Service, or submit any request by scripted, automated or repetitive means.
- 6.4.2 Use the Service to send spam, chain messages, phishing or unsolicited commercial communications, or to harvest contact information.
- 6.4.3 Submit unlawful, infringing, defamatory, harassing, obscene, hateful or deliberately misleading content through any interactive feature of the Service, or content that contains personal information about another person without a lawful basis.
- 6.4.4 Present, republish or characterise any output of the Service as investment advice, as a recommendation, as a research report, as a solicitation, or as the view of a named analyst or professional, or otherwise suggest that Gilver has advised you or anyone else.
- 6.4.5 Represent that Gilver endorses, sponsors, is affiliated with, or has verified any person, product, company, token or strategy.
- 6.4.6 Frame, mirror, white-label or embed the Service so as to obscure its origin, or use it to build a product that presents our content as someone else's.
- 6.4.7 Use the Service in violation of any applicable law, including securities, commodities, market-manipulation, sanctions, export-control, privacy and anti-fraud laws.
6.5 Enforcement
We may investigate any suspected violation and may, without notice and without liability, rate-limit, degrade, block, suspend or terminate access, remove content, and report conduct to law enforcement. We are not obliged to monitor the Service, and our failure to act on a violation is not a waiver of our right to act later.
7. Intellectual property
7.1 What we own
The Service and everything in it other than third-party data and third-party marks, including the software, source code, application architecture, user interface, visual design, typography, layouts, colour systems, animations, 3-D models, geometry, materials, shaders, scenes, "worlds", games and simulations, iconography, illustrations, text, documentation, methodologies, the selection, arrangement, structuring and compilation of data, and the name, logo and branding of Gilver and gilver.ai, is owned by Gilver or its licensors and is protected by copyright, trademark, trade dress, database and other intellectual property laws.
We reserve all rights not expressly granted in these Terms. No rights are granted by implication, estoppel or otherwise.
7.2 Your licence to use the Service
Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service for your own personal, non-commercial informational purposes. That licence is personal to you, may not be assigned, sublicensed, sold or otherwise transferred, and may be withdrawn by us at any time.
That licence does not permit you to copy, modify, adapt, translate, distribute, publicly perform, publicly display, sell, rent, lease, lend or create derivative works from the Service or its content, except as Section 7.3 expressly allows or as applicable law permits regardless of contract.
7.3 Screenshots, recordings and sharing
The Service is a visual product, and sharing images of it is permitted on the terms set out in this Section. Notwithstanding Section 8.2, and provided you are not otherwise in breach of these Terms:
You may:
- take screenshots, screen recordings, short clips and animated captures of the Service;
- share, post and embed them on social media, in newsletters, in blog posts, in videos, in presentations and in news, editorial, educational, academic and commentary contexts, including where that context is monetised in the ordinary way, such as an ad-supported article, a sponsored channel, or a paid newsletter;
- caption, crop, trim and annotate them as needed for that purpose.
In each case you must clearly credit Gilver or gilver.ai and, where the medium permits, link to https://gilver.ai; keep any attribution, source, credit or disclaimer text that is visible in the capture legible and unaltered; and not present the capture in a way that suggests Gilver endorses you, your content, or any investment view.
You may not:
- use captures in a way that transfers the underlying data rather than the image of it, including systematically capturing screens in order to extract, transcribe, tabulate, accumulate or reconstruct prices, figures or datasets;
- extract, transcribe, tabulate, accumulate or otherwise reuse as data the third-party market data visible in a capture, or include more than an incidental quantity of any one provider's data in a single capture or across a series of captures;
- use a capture, or any figure legible within one, in a commercial product, service, feed or data offering, or in any context where the figures themselves rather than the image of them are the value being supplied. Some data on the Service is licensed to us on terms that permit display inside the Service only, and nothing in this Section grants you any licence in that data;
- use captures in a manner that any of our data providers prohibits, or continue a use after we tell you that a provider has objected to it;
- redistribute, resell or license our imagery, 3-D assets, scenes, models or design as stock, templates, NFTs, merchandise, or as an asset within another product;
- use captures in advertising, packaging, product marketing, investment marketing, pitch materials for a financial product, or any material promoting a security, fund, token or trading service;
- alter a capture so that the figures, labels or relationships shown are misrepresented, or use one to imply a recommendation;
- use our name, logo or branding as your own, or in a way likely to cause confusion about source or affiliation.
The permissions in this Section 8.3 survive termination for captures you took while these Terms permitted it.
If you are unsure whether a particular use is permitted, write to siraj@gilver.ai and we will consider the request.
7.4 Our trademarks
"Gilver", "gilver.ai", the Gilver logo, and our other names, marks, logos and taglines are trademarks of Gilver, whether or not registered. You may use them only in plain text, in a truthful and descriptive way, to refer to the Service (nominative use), and in accordance with Section 8.3. You may not use them in a domain name, app name, social handle, product name, or in any way that suggests sponsorship, endorsement or affiliation.
7.5 Third-party marks, names and likenesses
The Service depicts, names and refers to real companies, products, exchanges, indices, digital assets, agencies and data providers. All third-party names, trademarks, service marks, wordmarks, logos, brand colours and trade dress are the property of their respective owners. They appear on the Service for identification, reference, illustration and commentary only, on a nominative-fair-use basis.
Gilver is not affiliated with, authorised by, sponsored by, endorsed by, or in any way officially connected to any company, issuer, exchange, fund, agency or data provider depicted on the Service, except where we expressly state a relationship. Depictions of a company's products, facilities, technology or business model are stylised, simplified, illustrative interpretations created by us for educational purposes. They are not the company's own material, are not approved by it, and should not be read as a factual account of its operations. Where a scene, game or simulation depicts a real company, it is a dramatisation.
7.6 Copyright complaints (DMCA)
If you believe material on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act to our Copyright Agent at the address in Section 1.1, marked "Copyright Agent", or by email to siraj@gilver.ai, including: your physical or electronic signature; identification of the copyrighted work; identification of the material claimed to infringe and where it is located; your contact details; a statement that you have a good-faith belief the use is not authorised; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for the owner.
We will respond as the DMCA requires and may remove or disable access to the material.
7.7 Counter-notification
If material you submitted was removed or disabled and you believe that was the result of mistake or misidentification, you may send our Copyright Agent a counter-notification under 17 U.S.C. § 512(g)(3) containing: your physical or electronic signature; identification of the material and the location at which it appeared before it was removed or disabled; a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, the United States District Court for the District of Delaware, and that you will accept service of process from the person who provided the original notification or that person's agent.
We may replace the removed material not less than ten (10) and not more than fourteen (14) business days after we forward your counter-notification, unless the complainant first notifies us that it has filed an action seeking a court order to restrain the activity.
7.8 Repeat infringers, and misuse of notices
We have adopted, and will reasonably implement, a policy of terminating in appropriate circumstances the access of any person who is a repeat infringer of copyright, and we may terminate access for a single infringement where the circumstances warrant it. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.
8. Feedback
If you send us ideas, suggestions, feature requests, bug reports, critiques or other feedback about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid, sublicensable and transferable licence to use, reproduce, modify and exploit that Feedback for any purpose, without restriction, attribution, compensation or any obligation to you.
Feedback is not treated as confidential. You should not send us anything that you consider confidential or proprietary, or anything that you are not free to provide on the terms set out above.
9. Third-party links, content and services
The Service links to and displays content from third parties, including news headlines, filings, source pages, provider websites and search results surfaced by AI grounding. Those links and that content are provided for convenience and reference.
We do not control, endorse, adopt, verify or assume responsibility for any third-party site, service, product or content, including its accuracy, legality, availability, security or privacy practices. Your dealings with any third party are solely between you and that third party.
10. Availability, suspension and termination
10.1 No uptime commitment
We do not promise that the Service will be available, uninterrupted, timely, secure or error-free. There is no service level agreement, no uptime guarantee and no support commitment. The Service may be unavailable because of maintenance, deployment, capacity, provider failure, network conditions, security response, or for no stated reason. Data feeds may pause or fail independently of the rest of the Service.
10.2 We may change or withdraw the Service
We may modify, suspend, limit, discontinue or permanently shut down the Service, or any feature, asset, page, data series or scene within it, at any time and without notice or liability. We may impose limits on use, or restrict access to certain regions or users.
10.3 Termination
We may suspend or terminate your access to the Service immediately, without notice and without liability, for any reason, including any suspected breach of these Terms or any conduct that we reasonably believe risks harm to us, to other users, to our providers, or to the Service.
You may stop using the Service at any time, and doing so terminates this agreement on your side. Because the Service requires no account, no cancellation step is necessary.
To exercise a privacy right, including deletion of information we hold, the Privacy Policy explains what we hold and how to make a request. Requests may be sent to siraj@gilver.ai.
11. DISCLAIMER OF WARRANTIES
THE SERVICE, ALL CONTENT ON IT, AND ALL DATA, FIGURES, VISUALISATIONS AND AI-GENERATED MATERIAL IT PROVIDES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GILVER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, DATA PROVIDERS AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, USAGE OR TRADE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: the Service will be available, uninterrupted, secure, timely or error-free; any defect will be corrected; the Service or the servers that deliver it are free of harmful components; any data, price, figure, estimate, model output or AI-generated statement is accurate, current, complete, reliable or fit for any purpose; the Service will meet your requirements or produce any particular result; or the Service will perform correctly on your device, browser or network. The Service uses hardware-accelerated 3-D graphics and may perform poorly, render incorrectly, or fail entirely on some devices, browsers and drivers.
NO STATEMENT ON OUR MARKETING PAGES, IN A HEADLINE, IN A FEATURE NAME, IN A BUTTON, IN A TOOLTIP OR IN AN ON-SCREEN LABEL — INCLUDING WORDS SUCH AS "LIVE", "REAL-TIME", "CURRENT", "GROUNDED", "VERIFIED", "INTELLIGENCE" OR "ACCURATE" — IS AN EXPRESS WARRANTY, A GUARANTEE, OR A DESCRIPTION THAT BECOMES PART OF THE BASIS OF ANY BARGAIN BETWEEN US. EACH IS A SHORT NAME FOR A FEATURE, NOT A PROMISE ABOUT ITS OUTPUT. SECTION 5 DESCRIBES WHAT THOSE FEATURES ACTUALLY DO.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE, CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.
12.1 Security
We maintain reasonable technical and organisational safeguards for the Service, including encryption of traffic in transit, access to production systems under individual credentials, exclusion of secrets from source control, and rate limiting on public endpoints. Those safeguards are measures, not guarantees. No method of transmission over the internet and no method of electronic storage is completely secure, and we cannot and do not guarantee that unauthorised access, disclosure, alteration or loss will never occur.
12.2 Where these exclusions do not reach
Some jurisdictions do not allow the exclusion of certain warranties or of implied conditions, so some of the above exclusions may not apply to you. In that case, such warranties are limited to the minimum scope and duration permitted by law.
13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GILVER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, DATA PROVIDERS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OPPORTUNITY, DATA, OR USE — AND, FOR THE AVOIDANCE OF DOUBT, FOR ANY TRADING OR INVESTMENT LOSS, ANY LOST GAIN OR PROFIT FOREGONE, ANY LOSS ARISING FROM A DECISION TO BUY, SELL, HOLD OR NOT TRANSACT, OR ANY LOSS ARISING FROM RELIANCE ON ANY PRICE, FIGURE, ESTIMATE, VISUALISATION OR AI-GENERATED STATEMENT — HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE OR OTHERWISE, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU ACTUALLY PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (US$100).
You acknowledge that the Service is provided free of charge, that these limitations are a fundamental basis of the bargain between us, and that we would not provide the Service without them. These limitations apply even if a limited remedy in these Terms is found to fail of its essential purpose.
14. Indemnification
You agree to defend, indemnify and hold harmless Gilver and its officers, directors, employees, contractors, agents, suppliers and licensors from and against any claim, demand, action or proceeding brought against an indemnified party by a third party, and any losses, liabilities, damages, judgments, settlements, costs and expenses (including reasonable attorneys' fees) awarded against, or paid in settlement by, an indemnified party in connection with such a third-party claim, to the extent it arises out of or relates to:
- your use of the Service in breach of these Terms or of applicable law;
- your misuse of the Service, including any scraping, redistribution or competing use prohibited by Section 7;
- your infringement or misappropriation of any intellectual property, privacy, publicity or other right of any third party;
- any content or information you submit to the Service, including prompts;
- your redistribution, republication or other use of any data, imagery or output obtained from the Service; and
- any financial or investment decision you or anyone relying on you makes in connection with the Service.
